A party is recognized as a state party if it meets any one of the following criteria in a particular state:

  1. It wins at least 3% of the total number of seats in the Legislative Assembly or 3 seats, whichever is more.
  2. It wins 1 seat in the Lok Sabha from the state and secures 6% of valid votes in a general election.
  3. It gets 8% of the total valid votes polled in the state in a general election to the Lok Sabha or the Assembly.
