The Parliament can make laws on subjects in the State List in the following three circumstances:

- The Union Parliament can legislate on a subject from the State List if the Rajya Sabha passes a resolution with a two-thirds majority indicating its national importance.
- The Parliament may enact legislation on a topic listed in the State List if two or more States agree, but the laws would apply only to the States that have granted their consent.
