The Indian Constitution includes a Directive Principle aimed at preserving the nation’s cultural heritage. Article 49 of the Directive Principles of State Policy states:
“It shall be the obligation of the State to protect every monument or place or object of artistic or historic interest, declared by or under law to be of national importance, from spoliation, disfigurement, destruction, removal, disposal or export, as the case may be.”
This article emphasises the State’s responsibility to safeguard historical monuments, places of cultural value, and archaeological sites. In accordance with this directive:
- The government has enacted laws such as the Ancient Monuments and Archaeological Sites and Remains Act, 1958.
- Institutions like the Archaeological Survey of India (ASI) have been established to ensure proper protection, maintenance, and restoration.
- The preservation of UNESCO World Heritage Sites in India also reflects the implementation of this principle.
Thus, Article 49 serves as a constitutional guideline to protect India’s rich cultural and historical legacy.
