During the Emergency, fear, censorship, arrests and pressure from the executive weakened the independence of many institutions. In April 1976, the Supreme Court ruled that a detained person could not seek judicial relief through a habeas corpus petition during the Emergency, accepting the government’s position. This controversial decision left citizens with little protection against arbitrary detention.
