The Constitution of India provides a detailed procedure for its amendment under Article 368. This procedure ensures that the Constitution remains flexible enough to adapt to changing needs yet rigid enough to prevent casual alterations. The method of amendment is partly rigid and partly flexible, and there are three types of amendments:

  • By a simple majority of Parliament, used for minor changes (e.g., formation of new states).
  • A special majority of Parliament requires a two-thirds majority of members present and voting, plus a majority of the total membership.
  • By Special Majority of Parliament with Ratification by Half of the State Legislatures, used for federal features like the election of the President, powers of the Union and states, etc.

This method allows the Constitution to maintain its foundational values while also evolving with the times.
