उत्तर
The procedure to file a complaint under the Consumer Protection Act is as follows:
Your complaint must be clear, unambiguous, and precise. Ensure your facts and paperwork are in order. You will need to include:
- A cause title.
- Ideally, the complaint should have a heading.
- The name, description, and address of the complainant (Your Name).
- The name, description, and address of the other party or parties, as the case may be, so far as they can be determined.
- The facts about the complaint, including when and where it arose.
- How and why are the opposing parties likely to face legal action? This petition requires an answer or accountability.
- Copies of papers supporting the claims made in the petition. Complainants are asked to save copies of the complaint/petition and everything provided. Documents for their records. A list of papers should be provided, along with the complaint, properly signed by you.
- To determine if a case falls under the tribunal’s jurisdiction, specify whether the opposing party resides, conducts business, has a branch office, or works for profit within the forum’s jurisdiction. Additionally, indicate whether the cause of action (damaged goods or deficient service) occurred within the forum’s jurisdiction.
- You are also entitled to recover the costs of your case from the other party. Hence, include that sum in your complaint.
