Three rights of an individual arrested under ordinary circumstances are:
- No person shall be detained in custody without being informed of the grounds for such arrest.
- He shall have the right to be defended by a lawyer of his choice.
- He has the right to be produced before the nearest magistrate within twenty-four hours of such arrest. He cannot be detained in custody beyond the said period without the orders of the magistrate.
Exceptions:
- The mentioned safeguards are not available to an enemy alien.
- These rights do not apply to persons detained under the Preventive Detention Act.
