उत्तर

Anita vs. Factory

Case: Anita and Sameer work in the same factory and have the same ITI qualification. Anita discovers that she is being paid less than Sameer for doing the same job. After repeatedly asking her employer to correct the difference in salary, she decides to approach the court.

Anita:

“Your Honour, Sameer and I have the same qualification and were appointed at the same time. We perform the same work and have similar responsibilities, but I am paid less than him only because I am a woman. I have already requested my employer several times to correct this unfair difference, but nothing was done. I believe that I should receive equal pay for equal work.”

Factory’s Point of View

Factory Representative:

“Your Honour, we do not intend to discriminate against Anita. The difference in salary may be due to factors such as experience, performance, responsibilities, or other employment conditions. We request the court to examine all the facts before reaching a decision.”

Considerations for the Judge

  • Whether Anita and Sameer are actually doing the same or substantially similar work.
  • Whether they have the same qualifications, responsibilities, and working conditions.
  • Whether there is a genuine and lawful reason for the difference in salary.
  • Whether Anita has been discriminated against because of her gender.
  • Employment records, salary details, appointment letters, and other evidence from both sides.
  • The principle of equality and equal pay for equal work.

Possible Outcome

If the evidence shows that Anita and Sameer perform the same work under similar conditions and there is no valid reason for the difference in their salaries, the court may order the factory to pay Anita equal wages and may also direct it to pay the appropriate difference in salary for the relevant period.
